Primary Legislation
Primary legislation refers to Acts of the Scottish and United Kingdom Parliament. Acts of Parliament are Bills (draft Act of Parliament) that have been fully scrutinised through the Parliamentary stages and have received Royal Assent. An Act of Parliament is enabling legislation that provides the legislative framework with detailed provisions often contained within secondary legislation.

Secondary Legislation
Secondary legislation refers to Regulations and Orders that are made under the enabling powers provided by primary legislation in order to implement and administer the requirements of that primary legislation. Secondary legislation is scrutinised by the Subordinate Legislation Committee of the Scottish Parliament.
