New powers granted to the Scottish Road Works Commissioner by the Transport (Scotland) Act (2019) allow him to carry out inspection of works by both public utilities and councils. Two new Compliance Officers have been appointed to carry out this role and, since the new powers came into effect on 1 April 2024, they have been focussing on compliance with the Safety at Street Works and Road Works Code of Practice at council road works sites.
