The Scottish Road Works Commissioner is pleased to announce that a local authority has successfully demonstrated substantial improvements in their on-site road works performance.
Following identification of a road works site, where serious shortcomings were found with signing, lighting and guarding, South Lanarkshire Council was issued a Compliance Notice in June 2026.
The authority met with the Commissioner, where the expected performance levels were established.
Following a 3 month period to make necessary improvements to process and procedure, the Commissioner recommenced monitoring of their sites. This found standards to be high, with no reoccurrences of the issues found previously, meaning that the required performance was achieved to allow their Compliance Notice to be closed.
The Commissioner, Kevin Hamilton, said:
“I am delighted that South Lanarkshire Council has been able to demonstrate their commitment to managing safety, both for the public and their own staff. This appears to have been an isolated incident and they have risen to the challenge of being issued with a Compliance Notice and made further reassuring improvements which play an important part in making our roads safer for all users.
Colin Park, Head of Roads, Transportation and Fleet Services, South Lanarkshire Council said:
“We were confident that this was an isolated incident and not reflective of the standards normally demonstrated across our road works. Nevertheless, we took the Commissioner’s concerns seriously, reviewed our arrangements and reinforced the standards expected.
“I am pleased that subsequent monitoring found standards to be high, with no recurrence of the original issues, and that the Compliance Notice has now been closed. This is a positive reflection on our staff and their commitment to maintaining safe, well-managed road works.”
Section 153A of the New Roads and Street Works Act 1991 (NRSWA) makes provision for the Commissioner to issue Compliance Notices where specific duties under NRSWA and Roads (Scotland) Act 1984 have been breached.
Failure to comply with a compliance notice is an offence, which upon conviction, can be subject to an unlimited fine.
