SP Energy Networks threatened with penalty for high-profile illegal closure

The Scottish Road Works Commissioner has issued a warning to SP Energy Networks for their unauthorised closure of Hanover Street in Edinburgh. 

The closure took place during the busy run up to Christmas and led to significant disruption to those travelling in the city centre. Following reports from the press, the Commissioner investigated, finding that Hanover Street had been closed unnecessarily and without the permission of the council between 29 November and 3 December 2025.

The investigation did not find evidence that SP Energy Networks had closed roads elsewhere and it was decided that issue of a penalty should be suspended dependant upon them not repeating this incident.

Should evidence be found of similar incidents, the Commissioner has powers to issue a penalty up to a maximum of £100,000.

Scottish Road Works Commissioner, Kevin Hamilton said:

“This incident, at a very busy time of year, had a major impact on people travelling through the city centre. Whilst it is often necessary to close roads to carry out works safely, the effects this can have on road users cannot be underestimated. Closure of Hanover Street without the permission of the council meant that steps could not be put in place to minimise the effects of the closure. It also seriously affected bus services along this key route. 

I am taking this matter very seriously and SP Energy Networks has assured me that it will not be repeated. I will, however, not hesitate to issue a penalty in the event that they do.”
