The Scottish Road Works Commissioner is pleased to announce that a local authority has successfully demonstrated substantial improvements in their on-site road works performance.
Following targeted monitoring of their road works sites, which identified problems with pedestrian facilities, North Ayrshire Council was issued a Compliance Notice in April 2025.
The authority met with the Commissioner, where the expected performance levels were established.
Following a 3 month period to make necessary improvements to process and procedure, the Commissioner recommenced monitoring of their sites. This found standards to have greatly improved, meaning that the required performance was achieved to allow their Compliance Notice to be closed.
The Commissioner, Kevin Hamilton, said:
“I am delighted that North Ayrshire Council has delivered such substantial improvements to how they manage pedestrian safety at their road works sites. They have risen to the challenge of being issued with a Compliance Notice and have demonstrated a real performance step change, making our roads safer for all users”
Section 153A of the New Roads and Street Works Act 1991 (NRSWA) makes provision for the Commissioner to issue Compliance Notices where specific duties under NRSWA and Roads (Scotland) Act 1984 have been breached.
Failure to comply with a compliance notice is an offence, which upon conviction, can be subject to an unlimited fine.
