Overview

Introduction

The Scottish Road Works Commissioner is an independent public official established under section 16 of the Transport (Scotland) Act 2005 and is accountable to the Scottish Ministers and ultimately the Scottish Parliament.

The Dial before you Dig service is provided by the Commissioner on behalf of the undertakers and road works authorities making use of the Scottish Road Works Register. Your request for information will be placed on the Scottish Road Works Register and passed to each undertaker and road works authority who have expressed an interest in receiving such requests. They are asked to provide you the information you request to the postal/email address you provide.

These terms of use tell you the terms of use on which you may make use of the Dial before you Dig service (our service). 

Please read these terms of use carefully before you start to use our service, as these will apply to your use of the service.

Using our Service

By using our service, you confirm that you accept these terms of use and that you agree to comply with them.

If you do not agree to these terms of use, you must not use our service.

You agree to take the necessary steps to inform the Commissioner immediately if you become aware of any breaches in data privacy or security.

We do not guarantee that our service, or any information provided, will be free from errors or omissions.

Reference to the Commissioner in these terms of use includes the Scottish Road Works Commissioner and their representatives.

We will make every effort to deliver the Dial before you Dig service to the best of our ability in accordance with these terms.

We will seek to develop and improve services as appropriate for the benefit of all members.

We are committed to data security and will take all reasonable and appropriate steps to protect your personal data.

 

Privacy Policy

This privacy notice sets out the personal data we collect about you, why we collect it and how we treat it.

The Commissioner’s basis for processing your personal information is based on your consent. This is further explained below, in the section ‘How will we use the information about you?’.

What information do we collect about you?

We collect information about you when you make a request through our service. We collect:

- your name

- your email address

- your postal address (if applicable)

- your telephone number

- the name of the organisation you work for (if applicable)

How will we use the information about you?

We use the personal information we hold about you in the following ways:

- To allow you to receive the information you have requested. 

- The Commissioner may contact you to ask if you received the information you requested.

Who will your data be shared with?

Your data will be shared with each undertakers and road works authorities who have expressed an interest in receiving such requests. 

We may provide anonymised information to third parties, but we will not supply any personal information that would enable you to be identified.

We reserve the right to give your personal information to a third party without your consent where we believe that such disclosure is:

- required by law

- necessary to assist in the prevention or detection of any criminal action

- is in the overriding public interest and is permitted by law.

We will always respect your privacy and any personal communication between you and ourselves. We will always comply with any data protection legislation currently in force.

Protecting your data

We are committed to data security and we take all reasonable and appropriate steps to protect your personal information from unauthorised access, loss, misuse, alteration or corruption. Access to your information and correction

You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of your personal information, please email or write to us at the following address: enquiries@roadworks.scot.

Requests to remove content

You can ask for content to be removed from our service records. We will remove content:

- in order to comply with data protection legislation covering the rights and freedoms of individuals.

- if it breaches copyright laws, contains sensitive personal data or material that may be considered obscene or defamatory.

No reliance on information

We only pass requests for the information you are asking for to authorised third parties. We are not responsible for the accuracy or content of any information provided to you by these third parties.

We make no representations, warranties or guarantees, whether express or implied, that the content provided through our service is accurate, complete or up-to-date. 

Data Sharing

Data recorded through our service will be published on open data platforms and made available for use by anyone. Personal or confidential data recorded in the relevant marked fields will be redacted prior to publishing.

Limitation of our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Scottish law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our service or any content provided, whether express or implied. 

We will not be liable to any user for any loss or damage (including without limitation, any direct, indirect or consequential loss or damage, or any loss of revenue, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, whether in contract, delict (including negligence), breach of statutory duty, or otherwise) even if foreseeable, arising under or in connection with:

- use of, or inability to use, our service; or

- use of or reliance on any content provided through our service.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our service or any content provided, or on any website linked therein.

We assume no responsibility for the content of websites linked in the information provided. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Applicable law

These terms of use, its subject matter and its formation (and any non-contractual disputes or claims), are governed by Scottish law. We both agree to the exclusive jurisdiction of the courts of Scotland.

We may update our service from time to time, although we are under no obligation to update it or to correct inaccuracies.
