Review of the office and functions of the Scottish Road Works Commissioner

Derek Mackay, Minister for Transport and the Islands, recently announced an independent review of the Office and functions of the Scottish Road Works Commissioner, with recommendations to be made to the Scottish Ministers by end March 2016.

Scope of Services

The Scottish Ministers, while not wishing to point the review to any particular outcome, require it to address three broad headings regarding the Office and its functions:-

Independence - necessity and extent of independence; governance models; how best to support the function/office; management of the SRWR and the statutory ‘Keeper’ role;

Improved collaboration – how to best fit with wider agenda on roads maintenance and viewing the road network as an asset; and

Enhanced enforcement – scope of offences, method of policing, possible sanctions.

Indicative Outputs and Milestones

It is anticipated that the Review will follow the following broad format :-

1. Evidence gathering/ Stakeholder engagement – Oct-Dec 2015

2. Analysis and discussion of emerging findings. Refine any final evidence gathered – January 2016

3. Drafting of Final Report – Jan-March 2016

4. Consultation on Final Report – Jan-March 2016

5. Submission of Final Report to Minister for Transport and Islands – March 2016

Note to Editors

Angus Carmichael took up the post of Scottish Road Works Commissioner in September 2015 and has over 40 years experience in this sector.

The post of Commissioner was established under the Transport (Scotland) Act 2005 to improve the planning, co-ordination and quality of road works throughout Scotland. The Commissioner monitors performance and promotes good practice across both utility companies and roads authorities (Councils for local roads and Transport Scotland for the trunk road network).
